“… En este trabajo se efectúo un estudio crítico del actual régimen previsional para personas magistradas nacionales, especialmente del recaudo atinente al cese definitivo exigido por la Ley 24.108 y su reglamentación, planteando que en aquel cuadro normativo, media una contradicción con derechos plasmados en la Constitución Nacional, sobre todo en alusión al derecho a la seguridad social, la razonabilidad, el derecho a trabajar y a la propiedad, y las garantías del artículo 110 de la norma cimera. De tal forma, la perspectiva analítica seleccionada propende a la combinación de aportes provenientes del derecho de la seguridad social y la rama constitucional, postulándose como conclusiones la necesidad de pensar en propuestas de reformas que mejoren el acápite criticado, a partir de reconocer el carácter fundamental del derecho a la seguridad social, junto a los deberes esenciales que en ese campo gravan la actuación estatal.   …”
